These Terms and Conditions govern the Customer's use of GCB’s Electronic Banking Service (the "Terms and Conditions").

These Terms and Conditions take effect (begin) when you register for Electronic Banking. GCB may change these Terms and Conditions from time to time. The latest version of the Terms and Conditions applies each time you use our Electronic Banking services.

You must read these terms carefully before using the Service. By registering to use the services or also by virtue of your continued usage of the Service, you shall be deemed to have accepted and be bound by these terms as well as other terms governing the service, as amended from time to time. If you reject these terms and conditions you cannot use the functionalities of our Electronic Banking services and cannot continue to Log-on to these services.

 

DEFINITIONS

In this Terms & Conditions the following expressions shall have the following meaning:

  • the Bank” means GCB Bank Limited (GCB) and its successors and assigns.
  • the Customer” means an account holder of GCB Bank Limited who is now or henceforth registered on the GCB Electronic Banking Service.
  • ‘Electronic Banking Service” ( “the Service”) –means any of the systems that enable the Customer to access his/her account and transact business, or obtain information on financial products and services. These systems are as follows:

 

  1. GCB Internet Banking;
  2. GCB Mobile Banking (including SMS Alert);
  • GCB Mobile Wallet Solution;
  1. GCB Merchant Point of Sale (PoS)
  2. GCB Card Services (MC, VISA, Readycash, E-zwich etc.);
  3. GCB Mobile APP (to include QR, NFC etc.);
  • GCB eCommerce (Mastercard Payment Gateway Service - MPGS). 
  • ‘Online’ - means access to the Service through any of these prescribed systems (or channels):
  1. the gcb.com.gh website with a computer;
  2. the GCB Mobile Banking Application or USSD platform (*422#) or any other short code published by the bank subsequently with the use of a mobile device;

iii. e-commerce Payment gateways for Mastercard, Visa, UPI or any other card scheme that may be acquired by the Bank;

  1. Merchant POS devices
  • ‘Password’ means any confidential password, phrase, code or number, or any other identification whether issued to the Customer by the Bank (including any Username and Memorable Answer) which may be used to access the Service through the designated systems (or channels) to effect Customer instr
  • ‘Personal Identification Number’ means any confidential Pin, Code or number issued to the Customer by the Bank which may be used to access the Electronic Banking Service or to execute instructions.

 

No Customer shall use the Service without understanding and agreeing to the Terms and Conditions of the Service.

By using the Service, the Customer thereby agrees and consents to these Terms and Conditions, which form the contract between the Customer and Bank. 

The Service shall be governed by these terms and conditions as amended by the Bank from time to time.

These terms and conditions shall be in addition to and not in derogation of other terms and conditions relating to any Account of the Customer and/or the respective service provided by the Bank unless otherwise specifically stated.

In consideration of the Bank allowing the Customer access to the Service, the Customer agrees with the Bank as follows:

  1. HARDWARE AND SOFTWARE REQUIREMENT
  2. a) The Customer shall access the Service by an ATM, POS device, a hardware device such as a personal computer, mobile phone either via a browser (such as Mozilla firefox, chrome, opera, internet explorer and edge) or an application and the necessary browser software and hardware, connected to the Customer’s preference of telephone service and internet access service.
  3. b) The Customer shall remain solely responsible for the purchase and maintenance of the device and associated browser hardware and software and the purchase of data to access the service.

 

GCB MOBILE BANKING APPLICATION

  1. GCB Mobile Banking is another channel of GCB Electronic banking which is accessed through an application on a mobile device. The Customer can use the same login credentials to access his/her account on his/her mobile phone. All the features and services available through Internet Banking are also available through the GCB Mobile Application.
  2. To access these features on your mobile device, you have to download the GCB Mobile Application from either the Google Play Store (for customers using Android devices) or Apple Store (for customers using IOS) and launch the Mobile Banking service from your mobile APP.
  3. The customer shall not install software onto his/her mobile device that he/she is not familiar with or the Terms and Conditions of which the Customer has not read.
  4. USERNAME, PASSWORD AND CONFIDENTIALITY
  5. a) The Customer shall initiate all Electronic Banking transactions or inquiries by use of his/her electronic banking username and password.
  6. b) The Customer shall not create a password or PIN that will be easy for others to determine. It is advisable to use a combination of upper and lowercase letters, numbers and characters.
  7. c)  The Customer shall keep his / her password or PIN confidential. The Customer shall act in good faith, exercise reasonable care and diligence in keeping the username, password or pin confidential. At no time and under no circumstances shall the customer disclose the username, password or PIN to any person or permit the hardware device or plastic card to come into the possession or control of any other person.
  8. d) The Customer shall not write his/her password or PIN or keep his/her plastic card in an open place to prevent third parties having access to his/her password or PIN and/or plastic card. The Customer shall be fully responsible for any accidental or unauthorized access to the plastic card, or for any accidental or unauthorized disclosure of the user name, password or PIN to any other person and shall bear the risks of the username, the password or PIN being used by unauthorised persons for unauthorised purposes.
  9. f) The Customer shall change his/her password or PIN immediately it comes to the notice of a third party.
  10. g) Where a Customer notifies the Bank of his intention to change his/her password or PIN resulting from memory loss, the Bank shall with the consent of the Customer immediately reset the old password or PIN and then allow the Customer to enter a new password or PIN PROVIDED THAT the Bank shall not be responsible for any loss that occurs between the period of such memory loss and the time that a new password or PIN is entered by the Customer.
  11. h) Until the Bank receives actual notice from the Customer (either in person,  by designated email or by means of telephone at such telephone numbers as the Bank may from time to time prescribe about the password or PIN being in the control or possession of an unauthorized person, the Bank is exempted from any liability whatsoever for complying with any or all instruction(s) given by means of the Customer’s password or PIN, if in any way the password or PIN comes to the notice of a third party.
  12. i)  The use of the Customer’s plastic card or password or PIN by any other person with his/her authorization shall be considered the same as the  Customer’s written signature authorizing the Bank to complete any transaction or request communicated through the Service.
  13. j) The Customer shall be responsible for any instruction(s) given through the Customer’s password or PIN. Accordingly, the Bank shall not be responsible for any fraudulent, erroneous or duplicate instructions given through the Customer’s password or PIN.
  14. k)  Sharing of the Customer’s password or PIN is strongly discouraged by the Bank and shall be done at the Customer’s sole risk and peril.
  15. l) The use of the Customer’s password by its employee or any other person with its authorization shall be considered the same as the Customer’s mandate authorizing the Bank to complete any transaction or request communicated through the Service.
  16. m) The Customer may at any time replace its users and may notify the Bank in writing if it so wishes.
  17. n)      The Customer shall after viewing his/her account, close his/her browser page and exit the Service.
  18. o) The Customer shall not leave his/her computer, plastic card mobile phone or similar technology referred to in 1(a) for accessing the Service at any place where a third party may have access to them.

 

  1. CUSTOMER’S RESPONSIBILITIES
  2. a) The Customer shall be absolutely responsible for safeguarding his/her password or PIN. Accordingly, the Bank is expressly exempted from any liability arising from unauthorized access to the Customer’s account as a result of the Customer’s failure to safeguard his/ her password or PIN.
  3. b) The Customer shall ensure the secrecy of his/her plastic card, password or PIN. Accordingly, the Bank is expressly exempted from any liability arising from the Customer’s breach of duty of secrecy.
  4. c) The Customer acknowledges that it is the sole responsibility of the Customer to ensure that the use of the Service is in accordance with the rules and regulations of the applicable law. The Customer undertakes not to use the Service to effect payment(s) for any illegal purposes (i.e. transactions not permitted under applicable laws, rules and regulations) including but not limited to money laundering, the transmission of any unlawful, libelous, offensive or obscene material.
  5. d) The Customer shall be required to acquaint himself/herself with the process for using the Service and that he/she shall be responsible for any error made while using the Service.
  6. e) It is the responsibility of the Customer to advise the Bank immediately of any change in his mobile number or loss/theft of mobile phone or loss/theft of plastic card by adopting the procedure laid down by the Bank for the purpo 
  7. f) The Telecom Service provider of the Customer may levy charges for each SMS / internet and the Bank is not liable for any dispute that will arise between such telecom service provider and the Custom
  8. g) The Bank shall upon receipt of notice of loss or theft of plastic card, de-activate the plastic card. The Bank is not responsible for any loss of funds, relating to the loss/theft of a plastic card, that occurs between the period of such loss/theft and the time that the plastic card is de-activated by the Bank

        

  1. CUSTOMER’S GUIDELINES
  2. a) The Customer shall provide true, accurate, current and complete information about himself/herself as requested by the Bank in the registration form. The Customer shall not misrepresent his /her identity.
  3. b) The Customer shall not assign or make any commercial use of the Service.
  4. c)   The instructions of the Customer shall be effected only after authentication under his/her USER ID and PIN or through any other mode of verification as may be later stipulated at the discretion of the Bank.
  5. d) While it shall be the endeavour of the Bank to carry out the instructions received from the Customer promptly, it shall not be responsible for the delay/failure in carrying out the instructions due to any reasons whatsoever including failure of operational system or due to any requirement of law. The Customer expressly authorizes the Bank to access his/her account information required for offering the services under the Service.
  6. e) The Customer understands that the Bank may send "rejection" or "cannot process" the request messages for the service request(s) sent by the Customer which could not be executed for any reaso
  7. f) The Customer  expressly  authorizes  the  Bank  to  carry  out  all  requests/ transactions purporting to have been received from his/her plastic card or hardware device and authenticated with his/her password/PI In the case of payment facilities like fund transfer, bills payments etc. the customer shall be deemed to have expressly authorised the Bank to make the payment when a request is received from him/her.
  8. g) The content and information on the Bank’s website as well as all rights to the web site are the property of the Bank. The Customer is only allowed to use the content and information as expressly authorized by the Services. Accordingly, the Customer shall not copy, reproduce, distribute, or create any derivative work from the content and information.

 

  1. BUSINESS DAYS AND NOTICE OF INTERRUPTIONS
  2. a) Electronic Banking services are available every business day including weekends and holidays except as provided below:
  3. i) technical failure or problems with a Communication System directly or

indirectly involved in providing Internet and Banking Services, be it the Bank’s  or a third party’s;

  1. ii) problems with a telecommunication or electricity service; or

            iii) other circumstances beyond our control

  1. b) The Bank may occasionally perform maintenance on systems and equipment and this may result in error messages or interrupted Services.
  2. c) The Bank shall within twenty-four hours of a disruption or anticipated disruption inform the Customer through short messaging system or other means determined by the Bank.
  3. d) If Electronic Banking services are unavailable for any reason, the Customer should communicate with the Bank in any other way so that the Customer limits potential losses on the Customer’s Account.

 

  1. RECENCY OF INFORMATION

6.1      All account information provided through Electronic Banking will be (current) as of the end of the preceding business day and will not reflect Bank transfers or deposits made since the end of the preceding business day and are subject to further adjustment and corrections.

6.2      It is the responsibility of the Customer to provide correct information to the Bank through the use of the Facility or any other method. In case of any discrepancy in this information, the Customer understands that the Bank will not be in any way responsible for action taken based on the information. The Bank will endeavour to correct the error promptly wherever possible on a best effort basis, if the customer reports such error in information.

 

6.3     The Customer understands that the Bank will try, to the best of its ability and effort, to provide accurate information and shall not hold the Bank responsible for any errors or omissions that will occur due to reasons beyond the control of the Bank.

 

6.4       The Customer accepts that the Bank shall not be responsible for any errors which will occur in spite of the steps taken by the Bank to ensure the accuracy of the information and shall not have any claim against the Bank in an event of any loss/damage suffered as a consequence of an information provided by the Bank found to be not correct.

 

  1. SERVICES
  2. a) The Customer may use the Electronic Banking Services listed in Schedule 1 attached hereto. Other Services shall be made available to the Customer as and when the Bank, adds on new Services.
  3. b) The Customer may sign up to the Services by contacting the Bank.

 

  1. TRANSFERS TO AND FROM ACCOUNTS AUTHORIZATION
  2. a)  The Customer expressly authorizes the Bank to debit the appropriate current or savings account in the amount of any bank transfer initiated through the Electronic Banking Service by the Customer or by any person who is authorized by the Customer to use his/her password or PIN.
  3. b) The Bank may treat any such bank transfer from a Savings account the same as a duly executed written withdrawal or transfer.
  4. c) The Bank shall upon the request of the customer make available to the customer in comprehensible form, information on conditions of transfer through the system as follows:

(i)         an indication of the time needed for the funds to be credited to the account of the institution of the beneficiary;

(ii)        an indication of the time needed for the funds credited to the account of the institution to be credited to the account of the beneficiary;

(iii)      details of any charges payable by the Customer; and

(iv)       details of any complaints and redress procedures available to the customer and means of access to them.

  1. The Bank will upon the receipt of a transfer in favour of the Customer, provide the Customer with information in a comprehensible form, including:

 (i)        the unique reference enabling the Customer to identify the transaction;

 (ii)      the original amount of the transfer; and

(iii)      the amount of charges payable by the Customer;

 

  1. e) The Bank will endeavor to make the funds transfer available to the Customer within the time limit agreed.

 

  1. LIMITATIONS OF SERVICES
  2. a) The Customer’s ability to initiate bank transfers between deposit accounts may be limited by the terms of the Customer’s deposit agreement with the Bank.
  3. b) The Bank may refuse to make any bank transfer for security reasons or otherwise provided in a deposit agreement with the Bank.
  4. c) The Bank cannot postdate bank transfers.

 

  1. LIABILITIES OF THE BANK
  2. a) The Bank will take reasonably practicable steps to ensure that its systems in connection with the Service are installed with adequate security designs and to control and manage the risks in operating the systems, taking into account any law, rules, regulations, guidelines, circulars, codes of conduct and prevailing market practices which may be applicable to the Bank, from time to

 

  1. The Bank, does not warrant nor represents that the Service is free from virus or other destructive features which may adversely affect the Customer’s hardware, software or
  2. Due to the nature of the Service, the Bank does not warrant that access to the Service shall be uninterrupted, timely, or error free. The Bank may suspend any of the services provided to the customer under the Service  without notice where the Bank considers it necessary or advisable to do so, for example to protect the Customer when there is a suspected breach of security  or the Bank needs to suspend the Services for maintenance  or where  other urgent  reasons so require.

The Bank will within twenty-four hours inform the Customer through short messaging system, our website(s) or other means determined by the Bank, if any of the services is not available

  1. d) In the event that the Bank has levied any charge to the Customer, which is specifically expressed to be for a particular service that is not available (which for the avoidance of doubt shall not mean any periodic fee charged for the Service as a whole) then the Bank shall reimburse the Customer this Other than reimbursing any sum as set out above, the Bank will have no further liability to the Customer.

 

  1. LIMITATION OF BANK’S LIABILITY
  2. a) To the fullest extent permitted by law, the Bank shall not be liable whatsoever for any loss, damage, or claim arising out of any delay or failure in the performance of the Electronic Banking in accordance with the Terms and Conditions.
  3. b) The Bank’s duties and responsibilities to the Customer are strictly limited to those described in these Terms and Conditions, except with respect to any provisions of the law applying to electronic fund transfers that cannot be varied or waived by agreement.

In no event, will the Bank be liable for any consequential, special or punitive damages, or for any direct or indirect loss, that the Customer may incur or suffer in connection with the Service, even if the Bank has been informed of the possibility of such damages.

  1. c) To the fullest extent permitted by law, the Bank shall not be liable at any time to the Customer or any other person for any loss, charge, fee, penalty, expense or other damage resulting from any failure or delay of the performance of the Bank’s responsibilities which is caused or occasioned by any act or thing beyond the Bank’s reasonable control, including without limitation, legal restraint, interruption of transmission or communication facilities, equipment failure, electrical or computer failure, war, emergency conditions, act of God, fire, storm, or other catastrophe.
  2. d) Use by the Bank or its Customers of any information obtained via the internet or internet access service provider’s network is at the Customer’s own risk and the Bank cannot guarantee the accuracy or security of any internet or network content.
  3. e) The Bank shall not be liable whatsoever for any damage or loss caused by the act, error, or omission of the Customer or any person purported to be acting for the Customer.
  4. g) The Bank shall not be liable for any fraud or loss that arises from the use of the Customer’s password.

 

  1. LIABILITY FOR UNAUTHORISED OR ERRONEOUS TRANSFERS
  2. a) The Customer shall bear all security risks arising from the use of the Service except the Bank’s internal risks such as internal fraud and identity theft and/or access to any Information or Report or any other information as a result of such use by the Customer or any other person authorized by the customer.

 

  1. b) If, in the reasonable opinion of the Bank, there is no negligence, fraud or fault on the part of the Customer, the Customer shall not be liable for loss or misplacement of funds caused by unauthorised transactions conducted through the use of the Service as a result of : -

       (i) a computer crime which should have been prevented by the risks control and         management measures had the Bank adopted such measures in accordance     with Clause 10(a);or

          (ii) a human or system error of the Bank.

 

  1. c) The Customer shall be responsible for all unauthorized or erroneous transactions initiated through Electronic Banking.
  2. d) The Customer shall indemnify the Bank, its officers and employees against all liabilities, claims, demand, losses, damages, costs, charges and expenses of any kind (including, without limitation, legal fees on a full indemnity basis) which may be incurred by any of them and all actions or proceedings which may be brought by or against any of them in connection with the provision of the Service, unless it is due to the gross negligence or wilful default of the Bank, or its officers or employ

 

  1. NOTICE OF TRANSACTIONS

The Bank shall notify the Customer of any transaction on the Customer’s account through electronic notification or a physical receipt as follows:

  1. a) Transaction amount;
  2. b) Transaction type;
  3. c) Any fees charged;
  4. d) Unique transaction reference;
  5. e) Date and time of transaction; and
  6. f) Identifying details of the recipient of an outbound transaction or of the sender of an inbound transaction

 

  1. ADDITIONAL SERVICES
  2. a) The Bank may from time to time, make additional services available through Electronic Banking and will notify the customer of the availability and the terms and conditions of these additional services.
  3. b) The Customer, by using these additional services when they become available, agrees to be bound by any additional instructions, procedures, terms and          conditions provided to him/her concerning these additional services.

 

  1. FEES AND CHARGES
  2. a) The service are available for a fee and service charges determined by the Bank from time to time. The Bank reserves the right to charge the Customer a fee for the use of the services provided under the Service. Display of such charges on the Bank’s website, Head Office and branches in a standard form determined by the Bank would serve as sufficient notice and the same is binding on the Custom
  3. b) Fees may be collected from the Customer in such manner and at such intervals as the Bank may specify. The Customer authorizes the Bank to debit any of his accounts with any fees and/or charges in relation to the use and/or termination of the services.
  4. c) The Bank shall give the Customer a prompt that continuing with the signing on process for any transaction would be taken as the Customer having read and accepted these Terms and Conditions.
  5. The Bank shall give seven (7) days prior notice to the Customer of a change in the fee structure through short messaging service or any other means determined by the Bank .This shall be binding on the Customer if the Customer continues to maintain or use the services after the effective date of this Agreement.

 

  1. INDEMNITY
  2. a) In consideration of the Bank providing the Service, the Customer agrees to indemnify and hold the Bank harmless against all actions, claims, demands proceedings, loss, damages, costs, charges and expenses which the Bank may at any time incur, sustain, suffer or be put to as a consequence of or arising out of or in connection with any services provided to the Customer pursuant hereto.
  3. b) The Customer shall indemnify the Bank for unauthorized access by any third party to any information/instructions/triggers given by the Customer or breach of confidentiality.

 

  1. SERVICE CHANGES AND DISCONTINUATION
  2. a) The Bank reserves the right to change or discontinue, temporarily or permanently the service at any time. In order to maintain the security and integrity of the Service, the Bank may also suspend the Customer’s access to the service at any time. The Bank will endeavour, in all cases, to inform the Customer through Short Messaging Service or other means determined by the Bank within twenty-four hours thereof.
  3. b) The Bank will not be liable to the Customer or any third party for any modification or discontinuation of the service.
  4. c) The Customer may cancel the Service by written request to the Bank at any time.

 

  1. NOTICES
  2. a) All notices and other communications to the Customer shall be in writing and delivered to the email address and phone number (text message), the Customer has provided to the Bank.
  3. b) All notices and other communications to the Bank from the Customer shall be in writing and delivered to the Bank’s address.

 

  1. COMPLAINTS
  2. a) The Bank will endeavour to maintain a functional consumer complaints unit to which the Customer shall lodge complaints, if any, through phone calls, electronic mails, short messaging service and personal visit.
  3. b) The Bank will endeavour to display the address, telephone numbers, and electronic mail address of the complaints resolution desk prominently at its branches and through its published electronic media channels (such as website, social media handles and publications).

 

  1. MARKETING BY POST, EMAIL OR TEXT MESSAGES

 

  1. If the Customer give the Bank permission, the Bank may use the Customer’s Personal Information to contact the customer about products, services, and special offers from the Bank or other companies that may interest the customer via post, email, or text message. 
  1. If the Customer is not interested in these sales marketing the Customer may contact the Bank, and the Bank will stop.

 

  1. AMENDMENTS 
  1. The Bank reserves the right to lay down further terms and conditions or to amend these Terms and Conditions (including any fees or charges) pursuant to the introduction of new products or technology or to take into consideration any increase in costs or decrease in the Bank’s return or for security, legal, regulatory or market reasons or changes in internationally accepted Banking 
  1. The Bank will give reasonable notice to the Customer of any addition and/or changes to these Terms and Conditions (which notice shall, in the absence of exceptional circumstances, be of 30 days). Such revised Terms and Conditions shall be binding on the Customer if the Customer continues to maintain or use the services on or after the effective date of v

 

  1. RECORDS RETENTION AND DATA PROTECTION
  2. The Bank will store information and instructions received from you through any means or device(s) used, for  a minimum of six years, as required by law,  and such information will be accessed by employees of the Bank (as is deemed necessary) on need-to-know basis.

 

  1. b) The Bank will comply with Data Protection Act, 2012(Act 843) and all applicable laws and regulations relating to the processing of personal data or privacy or any amendments and re-enactments thereof, and shall procure that its employees observe the provisions of the same.

 

22.      SETTLEMENT OF DISPUTES

  1. a) Any dispute arising from the Terms and Conditions, shall be settled amicably and where attempt at amicable settlement is unsuccessful, by arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 768) or any statutory modification or replacement thereof.
  2. b) The parties may by written agreement waive reference of any dispute arising under the Terms and Conditions to arbitration so that any dispute may be adjudicated by a court of competent jurisdiction.
  3. GOVERNING LAW

These Terms and Conditions and the rights and obligations of the Bank and the Customer shall be governed by and construed in accordance with the laws of Ghana.

 

  1. JURISDICTION

The courts of Ghana shall have exclusive jurisdiction in any action or proceeding relating to these Terms and Conditions.

Debit Card Terms and Conditions

1. THE CARD

Subject to the terms of this agreement, GCB Bank Plc (the Bank) shall issue at the Bank’s sole discretion, a Card to enable you obtain facilities and benefits made available by the Bank, make purchases from merchants who accept the MasterCard / Visa.

The Card may also be issued to withdraw cash from cash dispensers and ATM operated by the Bank and other members of MasterCard / Visa International up to such limits as may be notified to you by the Bank from time to time.

The Card at all times is and remains the property of the Bank and it must be returned to the Bank on request and may be repossessed at any time without notice by the Bank or by any person acting on the Bank’s behalf.

Until and unless this agreement is terminated, the Bank shall renew the Card from time to time and debit all applicable charges to your card account.

 

2. USE OF THE CARD

You shall comply with the following terms:

Keep the card secure at all times.

· Do not use the Card after the period for which it is stated to be valid or after any notification of its cancellation or withdrawal is given to you whether by the Bank or any person acting on behalf of the Bank.

· Memorize the PIN and destroy immediately upon receipt, the slip advising you of the PIN and always keep any record of it separate from the Card.

· Do not discard carelessly, used carbon copies containing the Card details as that information could be used to perpetuate fraud. When making a purchase, ensure that the merchant destroys any spoilt vouchers or receipts in your presence.

· Upon expiry, you can destroy the Card by cutting it. There is no need to return the Card to the Bank. The Card is not transferable and is valid for use only by the person whose name is printed on it during the validity period.

· The Card should not under any circumstances be used for any prohibited transaction (including online and overseas transactions). A prohibited transaction may include but shall not be limited to cryptocurrency or other block chain technologies howsoever described. The Bank shall not be liable for any currency losses you may suffer because of performance of a transaction as described herein. You agree to indemnify and hold the Bank harmless against any and all liabilities civil, or criminal arising out of or in connection with your use of the Card in the manner aforesaid.

 

3. PERSONAL IDENTIFICATION NUMBER

You shall be issued with a Personal Identification Number (PIN) to enable you to use the card. You are required to perform a change of PIN at the nearest GCB Bank ATM upon receipt of the Card.

You should keep your PIN confidential and never disclose it to any third party including the Bank’s staff, and the Bank will not accept any liability should you disclose your PIN to another person.

 

4. AUTHORISATION TO DEBIT ACCOUNT FOR FEES AND CHARGES

You authorize the Bank to debit your account with fees in respect of issuance, delivery, usage and renewal of the Card and with all transactions undertaken at any point of sale Terminals or ATMs with your Card and you take full responsibilities for these transactions. Should you request the Bank to deliver the Card to the address you provided through courier, you undertake to indemnify the Bank from any harm, actions, proceedings, claims, loss, damage, costs or expenses that may arise either directly or indirectly from the delivery of the Card.

You accept the Bank’s receipt of withdrawals and transactions as conclusive and binding.

 

5. LOST OR STOLEN CARD

· If the Card is lost or stolen, or a Card is for any reason liable to be misused or you have any reason to suspect that your PIN may have been discovered by an unauthorized person, you shall immediately notify the GCB Electronic Banking Centre on telephone number +33 302 246025, or at the nearest branch of the Bank and confirm such in writing seven days providing your account number and any other relevant information as may be required.

· Until and unless such notice is received, the Bank is authorized and shall remain authorized to debit your Card account for the transaction made using the Card.

· You shall be liable to the Bank for all losses or claims to the Bank arising from any transaction effected before such notice is received.

· You shall give the Bank and any person acting on the Bank’s behalf all necessary assistance in any investigations, make available all information as to circumstances of the loss, theft or possible misuse of the Card and take all reasonable steps to assist the Bank to recover the Card and money.

· You shall consent to the disclosure to third parties of such information as is relevant concerning your Card account in connection with loss, theft or possible misuse of your Card and money.

· If your Card is lost and reported to the Bank and you subsequently find it, you should destroy the Card by cutting it into pieces and report the discovery to the Card Centre.

· The Bank will as soon as practicable replace any lost or stolen card subject to payment of the applicable replacement charge.

 

6. CAPTURED CARDS

· If your card is captured at any ATM terminal, kindly walk to the branch where your card was captured with a valid national ID for pickup within 48 hours. For off-site ATMs you will have to visit the closest branch and arrange for pick up within 48 Hours. The card can be picked from any Bank branch whether GCB Bank or any other Bank.

· If the card is not picked up within 48 hours, the card would be deemed as compromised and would be eligible for destruction unless you communicate otherwise to the Bank.

 

7. LIABILITY

· If your Card transaction (including online and overseas transactions, if applicable) is converted into foreign currency or local currency for the purposes of the specific transaction (i.e. a service offered at certain ATMs and merchants which allows a Card member to convert a transaction from local to foreign currencies, and from foreign to local currencies at the point of withdrawal/sale, you acknowledge that the process of conversion and exchange rates applied will be determined by the relevant operator/merchant or currency conversion service provider as the case may be. The Bank does not determine whether a Card transaction will be converted into foreign or local currency, and where your transaction is for a retail purchase,

you may have to check with the relevant merchant whether such conversion was effected and at what rate the conversion was effected. The Bank shall not be liable for any exchange losses you may suffer because of the performance of a transaction as described herein.

· The Bank reserves the right to apply a retrospective debit/credit adjustment to your transaction to complete the settlement cycle of any such transaction based on prevailing exchange rates.

· In cases where the Dynamic Currency Conversion (DCC) or Multiple Currency Pricing (MCP) is used in settlement for overseas or online transactions, the conversion is performed by the merchant or ATM and not by the Bank. The exchange rate applied may differ from the exchange rate used by the Bank for interbank transactions, and as a result, you may incur additional costs or charges.

· In the case of a Card Refund, the exchange rate may fluctuate between the time of the transaction and the time the refund is processed. The refund amount may be less due to the change in the exchange rate.

· You are liable for any additional costs, fees, or charges resulting from exchange rate fluctuations.

· The Bank is not responsible for any damages or losses you incur as a result of any DCC/MCP or Card Refund transactions.

· You are advised to carefully review all transaction information and fees before completing an international transaction.

· The Bank shall not be liable in any way if a third party does not honor the Card.

· You shall be liable for any loss or cost suffered by the Bank as a result of any breach of this agreement.

· The Bank shall not be liable if it is unable to perform its obligation under this agreement due to failure of any machine, data, process system, transmission link, industrial dispute, terrorist action, or anything outside its direct control or that of its agents.

· By using your Card for international transactions, you agree to waive any liability against the Bank for costs or charges related to Dynamic Currency Conversion or Card Refund.

 

7. CARDHOLDER CLAIM

Your Card account shall only be credited with a refund in respect of a Card transaction if the Bank receives a refund voucher or other refund verification acceptable to it.

No claim by you against a third party may be the subject of defense or counter claim against the Bank.

§ You shall not be entitled to any interest or any credit in your account.

§ You shall not be entitled to a cash refund for any goods or tickets obtained with the use of the Card.

 

8. MAIL ORDER / TELEPHONE ORDER / INTERNET TRANSACTION

· You agree to be liable for all such Card transactions and in proving that the transaction was authorized by you, the Bank shall be entitled to rely on such documentary evidence as may be available to it which confirm that you gave your Card number to a merchant by mail or other order and the Bank’s right shall not be affected or defeated by reason of your not having placed, confirmed or renewed the order or received the goods in question.

 

9. MASTERCARD / VISA INTERNATIONAL REGULATIONS

The use of the Card is regulated by the terms of MasterCard/Visa International and you agree to abide by those terms as they shall be communicated to you by the Bank from time to time.

Any charges made by MasterCard/Visa International on foreign currency transactions shall be debited to your Card account. The amount of Card transactions and charges rendered involving foreign currency shall be converted into Ghana Cedis at the exchange rate quoted by MasterCard/ Visa International on the date the debit is received and any exchange gain or loss shall be debited to your account.

 

10. AMENDMENT AND GOVERNING LAWS

These conditions, varied from time to time constitute the agreement between you and the Bank with respect to the issue and use of the Card.

The Bank reserves the right to vary, amend or replace all of these conditions at any time without prior notice to you.

The Bank shall notify you of any changes made to these conditions as soon as practicable, but failure to make such notification shall not invalidate the changes.

You shall be deemed to have read, understood and agreed to be bound by these conditions upon your signing of the application form.

This agreement is governed in all respects by the laws of the Republic of Ghana and the parties submit to the exclusive jurisdiction of the Ghanaian courts.

 

Definitions:

Dynamic Currency Conversion (DCC): It is a service that allows customers to pay for a product or service in a foreign country using Ghana Cedis (GHS) instead of the local currency

Multiple Currency Pricing (MCP): A service that allows online merchants to offer customers the option to pay in their preferred currency, using a pre-determined exchange rate set by the merchant.

Personal Identification Number means any confidential code or number issued to a Customer by the Bank which may be used to access the Card Service.

You/Your means the customer or cardholder.
